Although recent legislation has changed the litigation landscape in many areas, the arena of class actions and mass torts continues to grow. These multi-plaintiff claims are often found in the context of environmental issues, pharmaceutical products, products liability, and other areas, including professional liability. The claims may ultimately be certified as a class, subject to a consolidated multi-district litigation proceeding, or simply presented in an uncertified multi-plaintiff action. Given the large dollars at stake, the volume of claimants, and the number of service providers affiliated with each mass tort, collateral litigation involving the service providers, law firms, clients, insurance carriers, and professional ethics is often a consequence of class actions and mass torts.
