Coverage Counsel
Our lawyers regularly evaluate coverage claims arising out of a wide variety of errors and omissions policies for attorneys, accountants, architects, medical health professionals, mental health professionals, real estate brokers, architects and engineers, nursing homes, and directors’ and officers’ claims. We have extensive experience with both insuring agreements and common exclusions and we also regularly litigate conflicts between primary and excess carriers. In addition to evaluating coverage issues under these types of policies, we also have a long history of prosecuting declaratory judgment actions and defending lawsuits by policyholders under such coverages. One of the highest compliments of our expertise in this area is the fact that several of our lawyers are routinely engaged by other lawyers and other carriers to testify as expert witnesses on claims-handling issues arising under professional liability policies. Founding partners Christopher Martin and David Disiere are regularly retained to provide expert evaluations of claims and cases arising out of various types of professional liability coverages.
Defense Counsel
Our lawyers are retained by some insurers to defend professional malpractice and professional malfeasance claims. Our lawyers have previously defended attorneys, accountants, health care professionals, real estate brokers, insurance agents, and architects and engineers in tort claims in Texas. Our firm is particularly known for our expertise regarding legal malpractice claims and legal ethics. As such, our firm represents a wide array of lawyers and law firms in a wide variety of claims and lawsuits.
Moreover, Mr. Jefferson is regularly asked to speak on the subjects of legal malpractice, fiduciary litigation and related trial topics. Mr. Jefferson has spoken at a variety of State Bar of Texas programs including the Advanced Evidence and Discovery Seminar, the Advanced Personal Injury Seminar and the Fiduciary Litigation Course. In 2016, Mr. Jefferson was selected to be the course director of the program. Mr. Jefferson has also spoken on these topics at various law school sponsored CLE programs and for the Texas College of Judicial Studies.
